Our Work
Our Work with Boards, Tribunals and Institutions
For many Canadians, their interaction with legal processes will involve engaging with some type of administrative body tasked with making decisions outside formal court processes. While each of these specialized boards, tribunals and institutions is unique, in general, all are expected to carry out their mandate in a manner that is unbiased, fair and transparent.
Often these types of bodies are required to consider not only the rights and obligations of the specific parties appearing before them, but must also consider the broader public interest. Understanding this context is central to us being able to provide tailored and pragmatic advice and representation to various types of boards, tribunals, and institutions and the corporations and individuals appearing before these bodies.
Key Focus
Professional Disciplinary Bodies
We have experience providing independent legal advice to a variety of professional disciplinary bodies responsible for performing administrative, investigative and adjudicative functions. We provide support during fact-finding and decision-making processes such as facilitating mediations and settlement negotiations, conducting hearings and providing support to decision-makers during deliberations, judicial reviews, appeals and responding to challenges and reviews of their decisions. We also have experience providing specialized training for tribunal members to support them in successfully fulfilling their roles and developing the skills they need as decision-makers.
Regulatory Bodies
We work with regulatory bodies in our key practice areas to provide comprehensive advice that supports each client to meet their specific objectives, fulfill their mandates and meet their broad obligations and expectations relating to fairness and transparency. We routinely review and provide comment and advice on the laws, regulations, policy and guidelines that govern regulatory bodies and offer strategic advice on the potential impacts of regulatory proposals to anticipate and mitigate legal risks. We also support regulatory bodies to develop, engage with stakeholders and ultimately implement internal policies, training and guidance necessary to carry out their unique roles and functions.

Our experience includes:
Ombudsman: Supporting and responding to the investigation and resolution of public complaints against government entities, reviewing policies and making and implementing Ombudsman recommendations.
Commissioners: Participating in the conduct of inquiries on public issues, supporting witnesses providing evidence and reviewing and responding to recommendations.
Appellate bodies: Supporting tribunals tasked with hearing appeals from administrative bodies, ensuring processes, procedure and decisions are fair, reasonable and clearly communicate.
Courts: Representing decision-making tribunals responding to a judicial review or clients challenging tribunal process and decision-making and providing assistance to implement judicial orders and directions resulting from judicial review.
